\nDeath Certificate [38 CFR 3.211 (a)(1)]\n\n
\nIf the foregoing evidence cannot be furnished, the reason must be stated. \nThe fact of death may then be established by the affidavits of persons \nwho have personal knowledge of the fact of death, have viewed the body of \nthe deceased, know it to be the body of the person whose death is being \nestablished, setting forth all the facts and circumstances concerning the \ndeath, place, date, time and cause thereof.\n\n
\nIf proof of death, as defined in paragraphs (a) through (e) of this \nsection cannot be furnished, a finding of fact of death, where death is \notherwise shown by competent evidence, may be made by an official \nauthorized to approve such findings. Where it is indicated that the \nveteran died under circumstances which precluded recovery or \nidentification of the body, the fact of death should be established by \nthe best evidence, which from the nature of the case must be supposed to \nexist.\n\n
\nIn the absence of evidence to the contrary, a finding of fact of death \nmade by another Federal agency will be accepted for the purposes of \nparagraph (f) of this section.\n\n

\nA copy of the public record of the State or community where death \noccurred [38 CFR 3.211(a)(1)]\n\n
\nDeaths under VA auspices include deaths where the VA receives a medical \nrecord from a non-VA provider documenting a death that occurs while the \nnon-VA provider was furnishing authorized non-VA care; deaths occurring \nin a contract nursing home (i.e., a nursing home under contract with the \nVA to care for the individual); or deaths during a home visit when a VA \nprovider is present. Documentation of the death should be received from \nthe non-VA provider or VA provider and entered into the persons record.\n\n
\nRequires receipt of a successful identity match providing the confirmed \nDate of Death via one of the three search functions available within EVVE \nFact of Death Query: 1) Insurance Regulatory Settlement Agreement, 2) \nSSN Exact Match, 3) Custom. Retention of electronic or hard copy \ndocumentation of the returned data is required. (Currently available via \nthe EVVE pilot program only)\n\n
\nA copy of a coroner's report of death or a verdict of a coroner's jury of \nthe State or community where death occurred, provided such report or \nverdict properly identified the deceased. [38 CFR 3.211 (a)(2)]\n\n
\nA death certificate signed by a medical office where death occurs in a \nhospital or institution under the control of the US Government.\n\n
\nA clinical summary or other report showing fact and date of death signed \nby a medical officer where death occurs in a hospital or institution \nunder the control of the US Government.\n\n
\nAn official report of death of a member of a uniformed service from the \nSecretary of the department concerned where death occurs while deceased \nwas on the retired list in an inactive duty status or in the active \nservice.\n\n
\nA US consular report of death bearing the signature and seal of the US \nconsul if death occurs abroad.\n\n
\nA copy of the public records of death authenticated by the US consul or \nother agency of the State Department if death occurs abroad.\n\n
\nAn official report of death from the head of the department concerned, \nwhere the deceased person was at the time of death, a civilian employee \nof such department where death occurred abroad.\n\n
